Defective Product Claims in Louisiana

In Louisiana and throughout the United States, product manufacturers have a responsibility to design, produce, and sell products that are reasonably safe for ordinary consumer use. Products should be free of defects that could cause foreseeable harm—but this does not always happen.

When manufacturers and distributors prioritize profits over public safety, they can and should be held accountable. At The Hall Law Firm, our Shreveport product liability lawyers have decades of experience going up against major manufacturers and fighting for the rights of injured consumers.

If you or someone you love was harmed by a defective product, we can help you seek the justice and fair financial compensation you deserve.

What Makes a Product Defective?

There is a difference between products that are defective and those that are simply dangerous. A dangerous product does not necessarily contain a defect; rather, to be considered defective, a product must have some flaw or characteristic that makes it unreasonably unsafe when used correctly and without modifications.

There are three types of product defects:

  • Design Defects: A design defect refers to a flaw in the initial design of the product that makes it inherently unreasonably unsafe for normal use. For example, a top-heavy vehicle that rolls over easily may have a defective design.
  • Manufacturing Defects: Products with manufacturing defects may be properly designed, but an error during production results in the product missing critical components or otherwise becoming unreasonably unsafe for normal use.
  • Labeling Defects: If a product is missing important labels, such as safety warnings or instructions, it may have a labeling defect. This also applies to products that are marketed for off-label and/or untested uses (often referred to as “marketing defects”).

By identifying the type of defect a product has, our attorneys can typically determine who is liable. We work with some of the industry’s leading experts, including accident reconstructionists and medical professionals, to meticulously investigate our clients’ claims and build powerful, evidence-based cases on their behalf.

Common Defective Products

Any industrial or consumer product has the potential to be defective. That being said, some products are more likely to contain defects—and cause serious injuries or deaths—than others.

Some of the most common defective products include:

  • Automobiles: Automobiles and auto parts often contain defects, leading to devastating accidents, injuries, and deaths. Examples include defectively designed vehicles, as well as defective airbags, seatbelts, brakes, power steering, and engine components.
  • Drugs and Medical Devices: Defective pharmaceutical drugs and medical devices include proton pump inhibitors, antidepressants, metal-on-metal hip and knee replacements, heartburn medications, birth control pills and devices, and more.
  • Children’s Products: Some commonly defective children’s products include cribs, strollers, car seats, blankets, bottles, clothing, and toys. One common defect affecting children’s products includes items that are missing choking hazard warnings.
  • Household Appliances: Defective household appliances often lead to devastating explosions and home fires. Some examples include defective water heaters, washers, dryers, stoves, ovens, refrigerators, and other gas and electric appliances.
  • Electronics: Personal electronics, as well as commercial electronic equipment, may cause serious injuries when defective. Examples of defective electronics include laptops, cellphones, batteries, chargers, and e-cigarettes.
  • Power Tools and Construction Equipment: Power tools that are missing safety guards or contain other defects can cause devastating injuries, as can other types of defective workplace equipment, such as ladders, scaffolding, forklifts, cranes, and safety gear.
  • Chemicals and Similar Substances: Industrial, agricultural, and household chemicals, cleaners, pesticides, herbicides, solvents, pain thinners, and similar substances can cause serious injuries, illnesses, and deaths when they are defective.

If you or someone you love was harmed by any type of defective product, you could be eligible to file a single-plaintiff personal injury lawsuit or take part in new or ongoing mass tort or class action litigation.
